Article 78 Claims

Under Section 7801 of the New York Consolidated Laws, also known as Article 78, a private citizen can obtain judicial review of state and local administrative proceedings and rulings. An Article 78 challenge is similar in many respects to a civil appeal, but applies only to the determinations of government officials and agencies. An Article 78 proceeding must generally be brought within a short period of time after the challenged decision is implemented, sometimes as little as 30 days, but no more than 4 months. In most instances, Article 78 proceedings are handled without a court appearance, exclusively through the filing of written documents.
